Terms of Service

The short version
agenthelp gives your business an AI assistant that answers customer questions, books appointments, and captures leads. You're responsible for the business information you give it and for reviewing what it does; we're responsible for running the service well. AI can make mistakes — check your transcripts. Be fair to your customers, don't use the service for anything unlawful, and you can cancel anytime.
1. Who we are, and what you're agreeing to
These Terms of Service ("Terms") are an agreement between agenthelp ("we," "us") and the business that creates an account ("you"). They govern your use of the agenthelp service: the AI assistant, the hosted assistant page, the website widget, and the dashboard (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
2. Your account
You must be at least 18 years old and authorized to act for the business you sign up. Give us accurate information, keep your password private, and tell us promptly if you think someone else has accessed your account. You are responsible for activity that happens under your account.
3. What the Service does
The Service runs an AI assistant for your business. It answers customer questions using the business information you provide, books appointments against the availability you configure (or collects booking requests for you to confirm), and captures leads. You control it from your dashboard. We improve the Service continuously and may add, change, or remove features; if a change materially reduces what you pay for, we will tell you first.
4. Your content and your responsibilities
The business information you provide — your services, hours, prices, policies, and anything else you put in your assistant's setup — is yours. You give us permission to use it for one purpose: operating the Service for you (including showing it to your customers and using it to generate the assistant's answers).
- Keep your business information accurate and current — the assistant answers from it.
- Honor the appointments the assistant books within the availability you configured, or cancel them promptly through your dashboard.
- Only submit content you have the right to share.
5. AI-generated responses
The assistant's replies are generated by artificial intelligence from the information you provide. It is designed to say "I don't know" rather than guess, and every conversation starts by disclosing that it's an AI — but like all AI, it can still make mistakes or phrase things imperfectly. Review your transcripts, and treat the assistant as a helpful employee whose work you spot-check, not an oracle. The assistant does not provide legal, medical, financial, or other professional advice.
6. Acceptable use
You agree not to use the Service to:
- break the law, or mislead or defraud your customers;
- collect health information — the Service is not HIPAA-eligible and must not be used for protected health information;
- send marketing or bulk messages — the Service's text messages exist only to verify a customer's phone number at booking;
- probe, overload, or interfere with the Service, other businesses' data, or the assistant's safety measures;
- resell the Service or misrepresent who operates it.
We may suspend or close accounts that violate this section.
7. Text messages and phone verification
When a customer books an appointment, the Service sends them a one-time code by text message to confirm their phone number is real. By using the booking feature, you understand your customers will receive that verification text (their carrier's message and data rates may apply). We rate-limit these messages aggressively to prevent abuse.
8. Plans, billing, and cancellation
- The Service is a paid subscription. Current plans and prices are shown at signup and on your billing page; payment is processed by Stripe.
- Subscriptions bill in advance on a recurring basis and renew automatically.
- You can cancel anytime from your billing page; cancellation takes effect at the end of the current billing period, and we don't give refunds for partial periods unless the law requires it.
- If a price changes, we'll give you at least 30 days' notice before it applies to you.
9. Your customers' data
Conversations, bookings, and leads belong to your business relationship with your customers. We process that data on your behalf to run the Service, as described in our Privacy Policy. You're responsible for using it lawfully — including honoring your customers' requests to delete their information, which your dashboard's transcript controls let you do.
10. Our intellectual property
We own the Service — the software, design, and brand. We give you a limited right to use it while you have an account. Don't copy, modify, or reverse-engineer it, and don't use our brand without permission. Feedback you send us may be used to improve the Service without obligation to you.
11. Termination
You can close your account at any time. We can suspend or terminate your access if you breach these Terms, create risk for us or others, or stop paying — with notice when that's reasonable. After closure, your data is deleted as described in the Privacy Policy.
12. Disclaimers
The Service is provided "as is." We work hard to keep it accurate, fast, and available, but we can't promise it will be uninterrupted or error-free, and we make no warranties, express or implied, including fitness for a particular purpose.
13. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose.
14. Changes to these Terms
We may update these Terms as the Service evolves. If a change is material, we'll notify you (for example, by email or in the dashboard) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the United States and of the state in which we are organized, without regard to conflict-of-law rules. We'll both try to resolve any dispute informally first — write to us at the address below.
